Abstract
پیوستن به این کنوانسیون یک بازی برد - برد را، هم برای کشورهای متصدی حمل و هم برای کشورهای فرستنده از قبیل کشور ما به ارمغان می آورد. abstract in december 2008, the united nations adopted the convention on contracts for the international carriage of goods wholly or partly by sea, known as the “rotterdam rules”. if this convention becomes universally accepted, the carrier’s liability will increase, their immunity on the basis of the nautical fault exception (neglect or fault in the navigation, or management of the ship) will be eliminated, and their due diligence obligations will not be restricted to the period before and at the beginning of the voyage, but will also be an obligation throughout the whole of voyage. also, by introducing the idea of a “maritime performing party” in the convention, the number of people on whom these obligations and liabilities would be imposed will be increased. in sum, by analysis of the convention and, in particular chapter iv which is the main subject of this research, we can conclude and propose to our domestic legislators that there is a level of balance between the liabilities of the carriers and those of the shippers: contrary to the previous conventions, the rotterdam rules are not merely in favor of the shipper or the carrier but, in fact, accepting this convention will provide a win-win outcome for all countries. keywords: rotterdam convention, liabilities of the carrier, maritime act of iran, hague rules, homburg convention.
