Improving SOGI Asylum Adjudication: Putting Persecution Ahead of Identity

Abstract This article addresses the concern that decision-making in sexual orientation or gender identity (SOGI) asylum claims Europe is often unfair, and one way to remedy this by improving guidance provided decision-makers when interpreting Refugee Convention respect of these claims. We begin interrogating a number different guidelines models assess whether they contribute fairer system. show that, for based on SOGI, success invariably depends decision-maker’s assessment as claimant is, would be perceived their home country be, member SOGI minority, so belongs Particular Social Group. Such focus risks neglecting analysis actual risk persecution. set out our own recommendation approach prioritising SOGI-specific Country Origin Information (COI) persecution, rather than focusing applicants are ‘genuinely’ members minority. argue will lead outcomes less likely overturned appeal more consistent with Convention’s spirit letter.
