نقش دادستان در پیشگیری از وقوع جرم

چکیده

به موجب بند 5 اصل 156 قانون اساسی، پیشگیری از وقوع جرم با پیش بینی اقدامات مناسب وظیفه ی قوه قضاییه می باشد. نا گفته پیداست که این قوه به تنهایی و بدون یاری و همکاری قوای دیگر قادر به انجام این وظیفه ی مهم نبوده و نمی باشد. انجام این وظیفه نیاز به هماهنگی میان قوا و طراحی کیفیت ارتباط و پیش بینی راه حل ها و سازوکارهای مناسب و مفید در این زمینه دارد، لیکن قوه قضاییه در تشکیلات درونی خویش نیز نیازمند سازوکارهای مناسب در راستای پیشگیری از وقوع جرم است. دادستان به عنوان رییس دادسرا می تواند در پیشگیری از وقوع جرم نقش مهمی ایفا کرده و بخشی از وظایف قوه قضاییه را در این زمینه محقق سازد. در این مقاله تلاش می شود نقش دادستان به لحاظ جایگاه سازمانی او در دستگاه قضایی و عضویت در نهادها و سازمان های دولتی از قبیل ستاد پیشگیری و حفاظت اجتماعی، ستاد پیشگیری و مبارزه با جرایم خاص و شورای حفظ حقوق بیت المال در امور اراضی و منابع طبیعی، در پیشگیری از وقوع جرم مورد بحث و بررسی قرار گیرد abstract according to article 156(5) of the iranian constitution, the prevention of crime by appropriate means is a duty of the judiciary power. it is obvious that the judiciary alone, without the cooperation of the other powers, will not succeed in fulfilling this significant duty. this, therefore, requires consistency and integration between the judiciary and the other powers, planning and determining the nature of this link, along with preparing the methods and models of cooperation and its appropriate instruments. however, the judiciary, within its own framework, needs to provide appropriate weapons in order to prevent crime as effectively as possible. the chief prosecutor, as the chief of the prosecution service can play a significant role in making operational this task of the judiciary. in this paper, an attempt is made to explain and analyse this organizational role of the prosecutor, as much as possible, by making frequent reference to the fact that, for the purpose of crime prevention, the prosecutor is a member of different state organizations and institutions such as the community watch and prevention headquarters, the prevention and combating specific crimes headquarters and the council for the preservation of state assets in relation to public property and natural resources. keywords: prosecutor, prevention of crime, situational crime prevention, organizational prevention, criminality, delinquency.
