Capacity and Mitigation

چکیده
The U.S. Supreme Court’s recent decision in Roper v. Simmons [1] and the amicus briefs submitted in support of abolishing the death penalty for juveniles suggests that neuroscientific evidence will play an increasingly important role in shaping legal concepts of culpability [2]. As we saw in Chapter 9, neuroscience is already beginning to play an important role in insanity defense proceedings. In addition, when mental conditions do not meet the stringent standards required for exculpation on insanity grounds, they might still be relevant to culpability, either because they influenced the defendant’s mental state at the time of the offense (diminished capacity) or because they reduce the blameworthiness of the defendant for sentencing purposes (mitigation). Neuroimaging in these contexts may shed light on the mental state of the accused at the time of the offense in order to help juries and judges determine the defendant’s quality of thought or level of culpability. In these instances, neuroimaging evidence is relevant to the ‘mens rea’ element of the criminal offense, as explained below.

Analyzing Capacity Withholding in Oligopoly Electricity Markets Considering Forward Contracts and Demand Elasticity
In this paper capacity withholding in an oligopolistic electricity market that all Generation Companies (GenCos) bid in a Cournot model is analyzed and the capacity withheld index, the capacity distortion index and the price distortion index are obtained and formulated. Then a new index, Distortion-Withheld Index (DWI), is proposed in order to measure the potential ability of market for capacit...
متن کاملIntegrating Climate Change Adaptation and Mitigation with Urban planning for a Livable city in Tehran
Climate change impacts are seen within growing numbers of cities in low- and middle-income countries, so there is growing interest in the adaptation and mitigation plans and programs put forward by city authorities. This paper aims to provide a better understanding of the constraints which cities face them in this subject by analyzing the case of Tehran. City has a commitment to decentralizatio...
متن کاملDesigning a Reliable Distribution Network with Facility Fortification and Transshipment under Partial and Complete Disruptions
This paper designs a reliability distribution network with limited capacity under partial and complete facility disruptions. To increase the reliability of the distribution network, a new mixed integer linear programing model is developed by considering multiple mitigation strategies including diversification, fortification, and transshipment. The distribution network constitutes of reliable di...
متن کاملSustainable COVID-19 Mitigation: Wuhan Lockdowns, Health Inequities, and Patient Evacuation
The world is urgently looking for ways to flatten the coronavirus disease 2019 (COVID-19) curve, and many governments have resorted to implementing strict lockdowns, as researchers show the effectiveness of China’s approaches in containing the virus. However, this paper argues that the draconian lockdowns instituted in Wuhan, Hubei, China, may have actually contributed ...
متن کاملOn the Value of Mitigation and Contingency Strategies for Managing Supply Chain Disruption Risks
We study a single-product setting in which a firm can source from two suppliers, one that is unreliable and another that is reliable but more expensive. Suppliers are capacity-constrained, but the reliable supplier may possess volume flexibility. We prove that in the special case in which the reliable supplier has no flexibility and the unreliable supplier has infinite capacity, a risk-neutral ...
متن کاملRelevance vector machine and multivariate adaptive regression spline for modelling ultimate capacity of pile foundation
This study examines the capability of the Relevance Vector Machine (RVM) and Multivariate Adaptive Regression Spline (MARS) for prediction of ultimate capacity of driven piles and drilled shafts. RVM is a sparse method for training generalized linear models, while MARS technique is basically an adaptive piece-wise regression approach. In this paper, pile capacity prediction models are developed...
